In Washington State, a wrongful death claim arises and allows family members to sue for damages when a loved one’s death is caused by the negligent or wrongful actions of another party. Common causes of wrongful death include, but are not limited to, fatal car crashes, medical malpractice, defective products, and workplace accidents. In Washington, the “statute of limitations” or time in which a lawsuit must be filed is usually within three years of the date of death.
Damages

- Noneconomic Damages: Pain and suffering, loss of care, comfort, and companionship.
Washington’s wrongful death statutes are set forth in Revised Code of Washinton (RCW Chapter 4.20) specifically RCW 4.20.010 and RCW 4.20.020.
Beneficiaries Who Can File a Claim
- The personal representative of the deceased’s estate.
- Spouse, state registered domestic partner, or children (including stepchildren).
- Parents or brothers and sisters if there are no spouses, partners, or children.
